Welcome to GRAFTON, your gateway to luxury safaris and bespoke adventures. These terms and conditions (“Terms”) govern all bookings made with GRAFTON, headquartered in Dublin, Ireland and based in Arusha, Tanzania. By confirming a reservation, you agree to abide by these Terms in full. Please read them carefully and contact us if you have any questions or require clarifications.
GRAFTON’s Terms and Conditions require a 10% non-refundable deposit to confirm your luxury safari or adventure, with full payment due 60 days before departure (or immediately for bookings made within 59–30 days); tiered cancellation fees apply (loss of deposit if cancelled >60 days out, 50% of the tour cost if cancelled 59–30 days out, and 100% within 30 days or for no-shows), while company-initiated cancellations grant a full refund or transfer to an alternative tour.
Clients must hold valid passports, visas, and comprehensive travel insurance, and must follow guides’ instructions, respect local laws and wildlife regulations, and cover any personal expenses, gratuities, or damages resulting from their negligence.
Prices are quoted in both Euros and US Dollars and may be adjusted for currency fluctuations; inclusions typically cover accommodation, guided drives, park fees, and ground transfers, while international flights, beverages, personal expenses, and optional activities are excluded. GRAFTON arranges accommodation through third-party providers and is not liable for their failures, delays, or force majeure events, and personal data is handled in accordance with the Company’s Privacy Policy; all disputes are governed by Irish law and subject first to mediation in Dublin, Ireland.
By proceeding with your booking, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
1. Definitions
For the purposes of these Terms:
“Company” refers to GRAFTON, its agents, employees, and affiliates.
“Client” means any individual or group booking services with the Company.
“Services” include guided tours, safaris, hiking expeditions, transfers, accommodation arrangements, and any ancillary services provided by the Company.
“Booking Confirmation” is the written acknowledgement, including an invoice, sent by the Company once a deposit or full payment has been received.
2. Booking and Payment
A reservation is confirmed only upon receipt of the required deposit and issue of a Booking Confirmation.
A non-refundable deposit of 10% of the total tour cost is due within seven days of booking.
Full payment must be settled no later than 60 days before the tour start date.
For bookings made within 59 to 30 days of departure, full payment is required immediately.
We accept payment by bank transfer, credit card, and other methods as specified on your invoice.
3. Cancellations and Amendments
3.1 Cancellation by the Client
All cancellation requests must be sent in writing (email only) to gstt@graftonsafaris.com. Cancellation fees are calculated on the total tour cost and apply as follows:
More than 60 days before departure: loss of 30% non-refundable deposit.
Between 59 and 30 days before departure: 50% of total tour cost.
Less than 30 days before departure: 100% of total tour cost (no refund).
No-show (failure to join tour on departure date): 100% of total tour cost.
3.2 Cancellation by the Company
We reserve the right to cancel a tour for the following reasons:
Insufficient bookings (minimum group size not reached): notice given at least 30 days before departure.
Force Majeure events (e.g., war, natural disasters, government closures).
In either case, you may choose either:
A full refund of all monies paid, or
Transfer to an alternative GRAFTON tour of equal value (subject to availability).
3.3 Refunds and Processing
Refunds will be issued within 30 days of written cancellation confirmation.
Amounts refunded will be returned via the original payment method.
Bank or credit-card fees incurred during refund processing are borne by the client.
3.4 Amendments and Name Changes
Clients may request changes to their booking (dates, participants, rooming) subject to:
Availability of space and services.
An amendment fee of €50 per change, plus any additional supplier costs.
Name changes permitted up to 14 days before departure, and no changes within 7 days of departure.
3.5 Force Majeure
Neither party is liable for delays or failures caused by events beyond reasonable control (e.g., strikes, epidemics). We will endeavor to offer suitable alternatives but cannot refund services already rendered.
4. Travel Documents and Visas
Clients are responsible for obtaining valid passports, visas, and any required permits.
Passports must be valid for at least six months beyond the tour end date.
Visa fees, application procedures, and health clearances are not included unless explicitly stated.
Failure to secure necessary documentation does not obligate the Company to issue refunds.
5. Pricing, Inclusions, and Exclusions
All prices are quoted in Euro (€) and US Dollar (US$) and reflect current exchange rates. We reserve the right to adjust pricing in case of significant currency fluctuations or regulatory changes.
Inclusions may comprise:
Accommodation as specified.
Guided safari drives and park entry fees.
Ground transfers in designated vehicles.
Professional guides fluent in English and other languages.
Exclusions typically include:
International flights and airline baggage fees.
Personal expenses.
Gratuities, laundry, visas, and travel insurance.
Optional activities not specified in your itinerary.
6. Health, Safety, and Fitness
Clients must ensure they are in good health and physically capable of participating in chosen activities.
A medical questionnaire may be required prior to departure.
Hiking Mount Kilimanjaro demands a high level of fitness; clients should consult a physician.
The Company reserves the right to refuse participation to any client posing a risk to themselves or the group.
7. Travel Insurance
Comprehensive travel insurance, including medical evacuation coverage, is mandatory for all clients.
Proof of valid insurance must be provided no later than 30 days before departure.
The Company is not liable for costs arising from medical emergencies or evacuation without proper insurance.
8. Liability and Force Majeure
The Company is not liable for:
Delays, injuries, losses, or damages caused by third-party suppliers.
Acts of God, war, civil unrest, strikes, or other unforeseen events beyond our control.
In such Force Majeure events, the Company will use reasonable efforts to offer alternative arrangements but cannot compensate for losses.
9. Client Responsibilities
Clients agree to:
Follow guides’ instructions and respect local laws, customs, and wildlife regulations.
Behave responsibly to avoid endangering themselves, fellow clients, or local communities.
Cover costs for damaged property or equipment resulting from negligence or willful misconduct.
10. Privacy and Data Protection
We collect personal data solely to process bookings, fulfil our contractual obligations, and communicate with you. We will never sell or share your information for marketing purposes without consent. For full details, see our Privacy Policy.
11. Intellectual Property
All promotional materials, itineraries, photographs, and website content are the intellectual property of GRAFTON. Unauthorized use, reproduction, or distribution is prohibited.
12. Amendments to Terms
GRAFTON reserves the right to modify these Terms at any time. The version posted on our website at the time of your Booking Confirmation will govern your booking.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Ireland. Any disputes must first be referred to mediation in Dublin. If unresolved, disputes may be submitted to the exclusive jurisdiction of Irish courts.
